Appeals
Board of Immigration Appeals: You may appeal an order of removal by an Immigration Judge before the Board of Immigration Appeals. You must file the Notice of Appeal within 30 calendar days after the Immigration Judges oral decision or within 30 calendar days from the date the written decision was mail (if no oral decision was given). You may also appeal a USCIS decision on a Form I-130 or Form I-360 to the Board of Immigration Appeals.
Motion to Reopen: It is filed before the Immigration Court, BIA or USCIS based on new facts or documentary evidence.
Motion to Reconsider: It is filed before the Immigration Court, BIA or USCIS to request a review of unfavorable decision if the decision is based on incorrect application of law or policy.
